ST. PAUL, Minn. (FOX 47) -- A U.S. District Court judge has dismissed a federal lawsuit against two Olmsted County deputies.
The lawsuit was filed by Jonathan Jacobson. Jacobson alleged that deputies James McCormick and Polyxene Voltaire violated his constitutional rights during a strip search at the Olmsted County Adult Detention Center in Sept. 2009.
Jacobson had been arrested for driving under the influence. He allegedly admitted to smoking marijuana and drinking alcohol earlier in the day. Deputies were concerned Jacobson might have additional drugs and he was given a strip search, according to court documents.
U.S. District Court Judge Paul Magnuson ruled on Monday the deputies had reasonable suspicion that Jacobson may have had contraband and acted within the law when conducting the search.
The decision can be appealed within 30 days.
